1. Acceptance of Terms

By downloading, installing, accessing, browsing, or using any part of the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and us.

If you do not agree to all of the terms and conditions contained herein, you are expressly prohibited from using the App and must immediately uninstall and cease all use thereof.

We may modify these Terms from time to time, and such modifications will be effective upon posting the updated Terms within the App or otherwise notifying you. Your continued use of the App after any such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for updates. The “Last Updated” date at the top of this document indicates when these Terms were last revised.

2. Description of Service

AnchorSafe is designed to be a resource for the sailing community, offering a range of features intended to enhance safety, connection, and enjoyment while at anchor. These features may include, but are not limited to:

a. Anchor Alarms: Providing alerts based on your boat’s GPS position relative to a set anchor position and radius.
b. Remote Monitoring (If Applicable): Allowing you to remotely view certain data related to your boat’s anchoring status (subject to hardware and connectivity).
c. Displaying Location of Other Users (With Consent): Showing the real-time or last known location of other AnchorSafe users who have explicitly consented to share their location.
d. Proximity Alarms: Notifying you when other vessels or users come within a defined range of your boat (and vice versa, if they have this feature enabled).
e. Social Connection with Other Sailors: Facilitating interaction through features such as user profiles, shared anchorage information, and the ability to follow other boats and friends within the App.
f. Sharing and Rating Anchorages: Allowing users to share information about anchorages, including their characteristics, suitability, and ratings.
g. Following Boats and Friends: Enabling you to track the general location and status (e.g., at anchor, underway) of other users you choose to follow.
h. Anchor History: Providing a log of your past anchoring locations and durations.
i. Communication Features: Including in-app chat functionalities and the option for voice calls if users voluntarily share their phone numbers with each other.
j. Offline Functionality: Permitting limited use of certain features even without an active internet connection, with the understanding that real-time data and some interactive features may be unavailable.

We reserve the right to add, modify, or remove features of the App at any time without prior notice.

3. User Responsibility

You are solely responsible for your use of the App and for any decisions or actions you take based on the information provided within the App.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

You acknowledge that the App is a tool intended to assist you and should not be considered a primary or sole source of information for safety-critical decisions. You are responsible for exercising sound judgment, practicing safe seamanship, and utilizing official navigational resources such as charts, tide tables, and weather forecasts.

You are responsible for ensuring that your device meets the minimum technical requirements for the App and that you have a stable internet connection (when required for certain features).

4. Location Services

By using the App, you explicitly consent to the collection, processing, transmission, and storage of your device’s location data. This data is used to provide and enhance the App’s features, including displaying your location on a map, showing the location of other consenting users, enabling anchor alarms, and facilitating proximity alerts.

You have control over whether and when your location is shared with other users. You can enable or disable location sharing through the App’s privacy settings. Please review our Privacy Policy for more detailed information on how your location data is used and protected.

While we employ reasonable efforts to provide accurate location data, we do not warrant or guarantee the accuracy, completeness, reliability, or timeliness of any location information displayed within the App. Location data may be subject to inaccuracies due to factors including, but not limited to:

a. GPS signal availability and strength.
b. Device settings and hardware limitations.
c. Environmental conditions (e.g., weather, obstructions).
d. Errors in third-party mapping data.

You expressly acknowledge and agree that the location services provided by the App are for informational and assistance purposes only and should not be relied upon as a primary means of navigation or for any situation where precise and error-free location information is critical to safety. Always consult official navigational charts and use appropriate navigational techniques.

5. Social Features and Communication

When using the App’s social features and communication tools, you agree to adhere to the following guidelines:

a. Respectful Interactions: Treat other users with respect and courtesy. Do not engage in harassment, bullying, or the dissemination of offensive, discriminatory, or inappropriate content.
b. Lawful Use: Do not use the social features for any unlawful purpose, including the sharing of illegal content or the infringement of intellectual property rights.
c. No Spam or Unsolicited Communications: Do not send unsolicited messages, advertisements, or promotional material to other users.
d. Accuracy of Information: Do not misrepresent your identity or share false or misleading information.
e. Protection of Privacy: Do not share the personal information of other users without their explicit consent.
f. Reporting Misconduct: You are encouraged to report any violations of these guidelines or inappropriate behavior by other users through the App’s reporting mechanisms (if available).

You are solely responsible for your interactions with other users and for any content you share, post, or transmit through the App’s social features. We do not endorse and are not responsible for the conduct or content of other users.

If you choose to share your phone number with other users to enable voice call functionality, you do so at your own discretion and risk. We are not responsible for how other users may use or misuse your phone number. We recommend exercising caution and only sharing such information with trusted individuals.

We reserve the right, but have no obligation, to monitor, review, edit, remove, or refuse to post any user-generated content that we believe, in our sole discretion, violates these Terms or is otherwise objectionable.

We may suspend or terminate your access to the App’s social features, or your entire account, if we determine that you have violated these user conduct guidelines.

6. Anchor Alarms and Monitoring (If Applicable)

The anchor alarm feature is intended as a supplementary tool to help you monitor your boat’s position while at anchor. It should not be considered a foolproof system or a substitute for diligent and responsible anchoring practices.

We do not guarantee that the anchor alarm will always function correctly or will prevent your boat from dragging anchor, colliding with other vessels or objects, or encountering other hazards. You, as an individual sailor, remain solely responsible for ensuring the proper setting and monitoring of your anchor and for taking appropriate action in case of any issues.

The accuracy and reliability of the anchor alarm can be affected by various factors, including:

a. The accuracy of your device’s GPS receiver.
b. Obstructions that may interfere with GPS signals.
c. Battery life of your device.
d. App settings and configurations.
e. Environmental conditions such as strong winds, currents, and tidal changes.

If the App includes remote monitoring features, their functionality may be dependent on factors such as internet connectivity, power availability on your boat, and the proper functioning of any related hardware. We do not guarantee continuous or uninterrupted remote monitoring.

7. Offline Use

Certain features of the App may be accessible for offline use. However, the functionality available offline may be limited compared to the online version.

Features that typically require an active internet connection, such as real-time location updates of other users, live chat, downloading new anchorage data, or accessing the latest weather information, will not function when your device is offline.

The accuracy of any offline data (e.g., previously downloaded anchorage information) may be outdated and should be used with caution.

8. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the app is provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We expressly disclaim any warranty that the app will be uninterrupted, error-free, bug-free, secure, reliable, or that the results obtained from the use of the app will be accurate or meet your requirements. We do not warrant that the app or the servers that make it available are free of viruses or other harmful components.

You acknowledge and agree that your use of the app and any reliance on information provided through the app is at your sole risk. We make no representations or guarantees regarding the effectiveness, accuracy, or suitability of the app for any particular purpose, including but not limited to anchoring safety, navigation, or social interaction. This app is intended for use by individual sailors and not for commercial or company use.

Any material or information obtained through the use of the app is accessed at your own discretion and risk, and you will be solely responsible for any damage to your device, loss of data, or any other harm that results from such access or use.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall [Your Company Name/Your Name], its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for death, personal injury, property damage, loss of profits, data, use, goodwill, or other intangible losses) arising out of or relating to your access to or use of (or inability to access or use) the app, any content on the app, or these terms, regardless of the legal theory (whether based on contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

You specifically acknowledge and agree that [Your Company Name/Your Name] shall not be liable for the conduct of third parties, including other users of the app, and that the risk of harm or damage arising from such conduct rests entirely with you.

Without limiting the foregoing, you agree that the app is a tool to assist sailors and that we assume no responsibility for any outcome resulting from your use of the app, including but not limited to anchor dragging, collisions, groundings, or any other accidents or incidents. You, as an individual sailor, are solely responsible for ensuring the safety of your vessel and its occupants.

To the maximum extent permitted by applicable law, our total aggregate liability to you for all claims arising out of or relating to these terms or your use of the app shall be limited to the maximum extent permitted under Singapore law. In no event shall our total liability exceed SGD $1.00 or the amount you paid to us (if any) for the use of the app in the twelve (12) months preceding the event giving rise to the liability, whichever is lower. The intent of this limitation is to exclude liability to the greatest extent permitted by law.

You acknowledge and agree that the limitations of liability set forth above are essential elements of these terms and that we would not provide the app to you absent such limitations.

10. Indemnification

You agree to indemnify, defend, and hold harmless [Your Company Name/Your Name] and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

a. Your use of the App.
b. Your violation of these Terms.
c. Your violation of any rights of another party, including but not limited to intellectual property rights or privacy rights.
d. Any content you submit, post, or transmit through the App.
e. Your interactions with other users of the App.

You agree to cooperate fully in the defense of any such claim. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you shall not in any event settle any such matter without our written consent.

11. Intellectual Property

The App and its original content, features, functionality, design, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and other elements (collectively, the “App Content”) are and will remain the exclusive property of [Canalitech, Oguz Uncu] and its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App solely for your personal, non-commercial use in accordance with these Terms.

You may not reproduce, modify, distribute, publicly display, publicly perform, create derivative works of, decompile, reverse engineer, or otherwise exploit any part of the App or the App Content without our express prior written consent.

Any feedback, comments, suggestions, ideas, or other information you provide to us regarding the App (“Feedback”) will be our exclusive property. We will be entitled to the unrestricted use and dissemination of such Feedback for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

12. Modification of Terms

We reserve the sole right to modify or replace these Terms at any time. We will provide notice of any material changes to these Terms by posting the updated Terms within the App or by other reasonable means (e.g., email notification).

The “Last Updated” date at the top of these Terms indicates when the latest revisions were made.

Your continued use of the App following the posting of any changes to these Terms constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically for updates. If you do not agree to the modified Terms, you must stop using the App and uninstall it from your device.

13. Termination

We may terminate or suspend your access to all or any part of the App, with or without cause and without prior notice, including but not limited to if we believe you have violated these Terms or engaged in conduct that we deem inappropriate or harmful.

You may terminate your use of the App at any time by uninstalling it from your device.

Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination (including but not limited to disclaimers of warranties, limitations of liability, indemnification, and intellectual property provisions) will continue in full force and effect after any termination.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Singapore. You hereby irrevocably consent to the jurisdiction of and venue in such courts and waive any objection based on forum non conveniens.

15. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, and disclose your personal information, including location data. 16. In-App Purchases (If Applicable)

The App may offer in-app purchases for certain features, content, or services. If you choose to make an in-app purchase, you agree to the pricing and payment terms presented to you at the time of purchase.

All payments for in-app purchases are processed through the app store (e.g., Apple App Store, Google Play Store) from which you downloaded the App and are subject to the terms and conditions of that app store. We do not have direct control over the billing process.

Unless otherwise stated, all in-app purchases are non-refundable and non-transferable.

We reserve the right to modify the pricing of in-app purchases at any time.

Access to certain features or content of the App may require the purchase of an in-app subscription. Subscription terms, including billing frequency and cancellation policies, will be disclosed to you at the time of subscription.
